MANGALORE : The State High Court has dismissed the Habeas Corpus writ filed seeking to trace Ramya Shetty of Naringana, stating it was neither a kidnap or a Love Jihad case. The High Court bench comprising Justice Sridhar Rao and Justice Subhash B Adi which has said that the Ramya Shetty case has been settled, has directed the police to continue investigation into the case.
It may be recalled here that Ramya’s brother Shivaprasad Shetty in his writ had stated that his sister Ramya Shetty had been kidnapped by Mohammad who used to visit their house for carpentry works. The writ also said that 40 year old Mohammad was married and had taken his sister on December 4 after luring her of a job He had also alleged that the police had not initiated any action despite a complaint. The complaint while stating that this was Love Jihad case, had alleged that she had been converted to Islam in Ponnachi.
The court which had taken up the case for hearing had served a notice to Western Range IGP Gopal Hosur and had directed him to submit a report consequent upon which a 32 page report on the investigation into the case was produced before the court.
The court dismissed the writ and concluded that the police report had proved that Ramya Shetty was a major and had left with Mohammad at her on will and also that this did not seem to be a Love Jihad case.
Ramya’s family which had initially filed a case of missing in the Konaje station had later registered a case of kidnapping against Mohammad. Though it was evident that Ramya had loved Mohammad and had eloped with him, the entry of the Hindu organizations converted this case into a Love Jihad case.
