MANGALORE : The Second JMFC Court in Mangalore has stayed the civil works connected with the construction of a road for SEZ on the agricultural land belonging to Kudubipadavu near Permude and has further ordered to maintain the status quo till the completion of case.
The civil work for the construction of SEZ road on the agricultural lands owned by the Kudubis had been forcibly initiated. Opposing the move, Kudubi farmers like Honnayya Gowda, Pushpa and others had not only fenced their land but also obstructed the construction of the road. Later they filed a case against the proposed construction of the road, at second JMFC court in Mangalore. The court had then decided the case in favour of Kudubis and stayed the civil works. Following this, the Dix Shipping Company, the contractor of SEZ has appealed to the court to vacate the stay order. The court which heard the appeal, instead of vacating the stay had delivered a significant judgment of ‘permanent stay’ against the civil works.
As per the court orders neither the officers of the SEZ nor the SEZ contractor Dix Shipping are allowed to resume the civil works until the case is decided by the court. Courts usually grant temporary stay orders in such matters. However, this judgment comes as a great relief to the Kudubis. Celebrating their victory they have placed the banners bearing the court orders in such places where civil work was undertaken.
