Withholding of transfer orders of DySPs : Stage set for legal battle against CM’s move

BANGALORE: It has been learnt that a few police officials who were supposed to be transferred as per the recent orders of the Police Establishment Board which however has been withheld by the CM’s office, have decided to question the government action with the Karnataka Administrative Tribunal or the Supreme Court. The CM’s office had recently put on hold the transfer order of 64 officers of DySP rank by the Police Establishment Board.

The order issued by the Board Chairman and DGP Ajaykumar Singh on the basis of the efficiency and seniority of the officials, had been withheld by the CM on the grounds that some ruling party MLAs were against it. In fact, DGP Singh, displeased by the government action, had gone on leave.

Meanwhile, the transfer orders executed by the Police Establishment Board has been widely welcomed as earlier such orders used to come from the CM’s office. But, the government action has come in the way of the professional advancement of police officials while also kick starting a controversy.

Though the government has the authority to withhold such transfer orders issued by the Board only in exceptional cases, there is a rule that the government has to cite definite reasons for the same which however has not been done in this case.

Sources now reveal that the police officials who were hitherto in non-executive posts and were to be elevated to executive postings after the transfers are all likely to move the SC or the KAT by citing the assurances given by the government to the Supreme Court while constituting the Board.

On the other hand, even the Justice Thomas Monitoring Committee has taken serious cognizance of this controversy.
